Zurp Rewards Program Terms and Conditions

This document describes how the Zurp Rewards Program (“Rewards Program”) works and is an agreement between you and Zurp, Inc. You agree that use of your Zurp account (“Account”) or any feature of this Rewards Program indicates your acceptance of these terms and conditions (the “Rewards Program Terms and Conditions”).
In this document, the following words have the following meanings:
- “Account” means your Zurp Account that is linked to this Rewards Program.
- “Agreement” means this document.
- “Bonus Categories” is defined in the section of this Agreement titled “Bonus Categories.”
- “Card” means any credit card or account number used to access your Account.
- “Creator” means a celebrity or social media influencer that may offer products or services as rewards.
- “Points” or “Rewards Points” are the rewards you earn under the Rewards Program.
- “Purchases” is defined in the section of this Agreement titled “How You Can Earn Points.”
- “Rewards” means products and/or experiences you may redeem using accrued Rewards Points.
- “Rewards Offer” means the Points offered to you under the Rewards Program.
- “Rewards Program” means this Zurp Rewards Program.
- “We,” “us,” “our,” and “Zurp” mean Zurp, Inc. a Delaware corporation, and its affiliates.
- “You” and “your” mean the person responsible for the Account and for complying with this agreement.
Any capitalized term not defined herein shall have the meaning ascribed in the Terms and Conditions.
ELIGIBILITY
There is no additional purchase or fee required to enroll in the Rewards Program. The Rewards Program is open to Account holders who are United States citizens or lawful permanent residents of the fifty (50) United States, and who are at least eighteen (18) years of age when he/she creates an Account. In order to create an Account, you must download the Zurp App and provide the following information: legal name, email, residential address, social security number, and phone number. The Rewards Program is void where prohibited by law. One (1) Rewards Program membership is permitted per person and per Account.
All Accounts and Rewards Program memberships are subject to verification by Zurp at any time and for any reason. We reserve the right to verify your identity and eligibility to participate in the Rewards Program, as determined in our sole discretion.
EARNING POINTS THROUGH PURCHASES
You will earn Points on eligible purchases of products and services, minus returns or refunds (collectively, “Purchases”), made with a Zurp Mastercard Credit Card (the “Card”) by you. Buying products and services with your Card, in most cases, will count as a Purchase. However, the following types of transactions do not qualify as eligible Purchases and will not result in an accrual of Points:
- balance transfers
- cash advances or cash-like transactions
- travelers checks, foreign currency, money orders or wire transfers
- lottery tickets, casino gaming chips, race track wagers or similar betting transactions
- any checks that access your account
- interest
- unauthorized or fraudulent charges
- fees of any kind, including an annual fee, if applicable
You will earn 3 Points for each $1 spent on eligible Purchases.
From time to time, Zurp may offer additional Points for Purchases in certain categories.
BONUS CATEGORIES
For each of the following purchase categories (the “Bonus Categories”), you will earn 8 Points for each $1 spent on Purchases.
- Food
- Entertainment
- Travel
- Rideshare
Merchants who accept Mastercard credit cards are assigned a merchant code, which is determined by the merchant or its processor in accordance with Mastercard procedures based on the kinds of products and services they primarily sell. We group similar merchant codes into categories for purposes of making Rewards Offers.
Please note that we make every effort to include all relevant merchant codes in our Rewards categories. However, even though a merchant or some of the items that it sells may appear to fit within a Rewards category, the merchant may not have a merchant code in that category. When this occurs, Purchases with that merchant won’t qualify for Rewards Offers on purchases in that category.
Purchases submitted by you or the merchant through third-party payment accounts, mobile or wireless card readers, online or mobile digital wallets, or similar technology will not qualify in a rewards category if the technology is not set up to process the Purchase in that rewards category.
SIGN UP AND DEPOSIT PROMOTIONS
The following are promotional offerings that are currently available, and may be changed or suspended in Zurp’s sole discretion.
When you sign up and are approved for a Card for a new Account, you will receive 10,000 Points (the “Sign-Up Bonus”).
When you deposit your first $100 into your Account, you will receive 10,000 Points (the “Deposit Bonus”). To qualify, all deposits must be received by Zurp and cleared through the account they are sent from.
If you make $1,000 in net purchases (purchases minus returns) within your first three (3) months of opening your Account, you will receive 25,000 Points (the “Spend Bonus”). To qualify, the purchase transactions need to settle.
If you set up a payroll direct deposit of at least $1,000 for three (3) months in a row, you will receive 50,000 Points (the “Direct Deposit Bonus“). Direct deposits must be made from an employer, payroll, or benefits provider to qualify.
The Spend Bonus will be credited to your Account after the Zurp statement in which you have successfully made $1,000 in net purchases (within the first three (3) months of opening your Account) closes. To redeem these Points for Rewards, Active User status conditions apply. See the “Redeeming Points” section below for more information. From time to time, Zurp may offer additional Spend Bonuses for certain time periods.
EARNING POINTS THROUGH PAYING RENT
You will earn 1 Point for each $1 spent on rent or mortgage payments paid via ACH pull or through the Zurp app. Alternatively, by using the Zurp Card, you will earn 3 points for each $1 spent on rent or mortgage payments. In either case, you may earn up to a maximum of 4000 points per calendar month. Points for Rent or mortgage payments can only be earned for one (1) rent and/or mortgage payment per month.
EARNING POINTS ON STUDENT LOAN PAYMENTS
You will earn 1 Point for each $1 spent on a student loan payment paid via ACH pull or through the Zurp app. You may earn up to a maximum of 4000 points per calendar month. Points for student loan payments can only be earned for one (1) student loan payment per month.
EARNING BONUS POINTS
In addition to earning Points through eligible Purchases and promotions, you may earn bonus Points through participating in the Zurp Spin the Wheel Sweepstakes (the “Sweepstakes”). There is no purchase necessary to enter the Sweepstakes. For details on the Sweepstakes, see the Sweepstakes Official Rules here.
From time to time, we may offer you additional ways to earn bonus Points. Such bonus Points offers will be subject to separate terms and conditions, in addition to these Terms and Conditions.
ACCRUAL OF POINTS
Points are accrued at the time Purchases settle. Points will be deducted from the Point balance in the case of a chargeback, refund, or return. If you have more returns or refunds than Points earned from Purchases or bonuses, then Points will be deducted from your total Point balance and may result in a negative point balance.
You can view your current Point balance on the Zurp App.
We may, from time to time, provide additional ways for you to see Points you’ve earned, such as through Zurp.com.
Points earned are generally available to be used when the respective transactions have settled.
REDEEMING POINTS
You can use your Points to redeem any available reward option (“Rewards”) for which your Points qualify. Available Rewards may include (subject to change at any time), without limitation: gift cards, event tickets, discounts, merchandise, exclusive content, and exclusive experiences.
Redeeming Points Via Statement Credits
Many Rewards will be redeemable via statement credits. A statement credit, is term to describe the transaction has settled and/or cleared from your account showing it’s fully paid. Once you accumulate enough Points for a Reward you wish to redeem, you will open the Zurp App, find the Reward, and select the “redeem” option that corresponds to that Reward. You will then purchase the good or service you wish to redeem as a Reward using your Zurp card. We will then verify that your transaction successfully settled. On your next billing statement after the purchase has settled, you will receive a credit for the purchase in an amount up to the value of the redeemed Reward, as stated on the Zurp App.
Statement credits will appear on your billing statement at the end of each billing cycle. The credit amount shown is based on the Rewards you’ve redeemed during that billing cycle that are redeemable via statement credits. You will not earn credit for any returns, refunds, failed transactions, or canceled transactions. If you do happen to receive a statement credit for any Reward that has been returned, refunded, canceled, or otherwise has not successfully settled (an “Unfulfilled Reward”), we will reduce the credit from your next billing statement for an amount equal to the amount originally credited. If you have not received enough statement credits to offset the credit you received for an Unfulfilled Reward within 2 billing cycles, we will charge your Card for the remaining value of the Reward.
We may, from time to time, provide additional ways for you to use your Points in addition to those described in this Agreement, such as through Zurp or third parties.
At our discretion, we may offer discounts on rewards that are redeemable with your reward points. Discounts and the duration of time that the discounts are available may change at any time.
Redemption values for Rewards vary.
You are solely responsible for how Points are used.
Once Points have been used, the transaction is considered final and may not be canceled unless otherwise noted. Refunds are not available.
The amount of time it takes for the delivery of items depends on the item. Some items cannot be shipped to PO Boxes or foreign addresses.
Applicable sales/use taxes, fees, surcharges, and shipping and handling charges are your responsibility.
We are not responsible for replacing lost, stolen or damaged redemption items, including certificates, tickets or gift cards or for a Creator’s failure to honor them.
Except where required by law or provided for in these Terms & Conditions, Points have no cash value and no exchange rate to any market currency, and are not your property. Other restrictions may apply.
EXPIRATION OR LOSS OF POINTS
All Points shall expire if no Purchase is made using your Card for a period of two (2) years calculated from the date of last Purchase.
Points will be immediately forfeited if your Account status changes, or your Account is closed, for any of the following reasons, or for any other reason, as determined in Zurp’s sole discretion:
- you have a Negative Balance on your Account that is not paid off within 60 days of the Account reflecting a Negative Balance
- you fail to comply with these Terms and Conditions or other agreements you have with Zurp
- we believe you may be unwilling or unable to pay your debts on time
- you file for bankruptcy
- we believe that you’ve engaged in fraudulent activity related to your account or the Rewards Program
- we believe that you’ve misused the Rewards Program in any way, for example:
- by buying or selling Points
- by selling, or participating in the sale or exchange of items and services of value obtained through use of Points
- by repeatedly opening or otherwise maintaining credit card accounts for the purpose of generating rewards
- by manufacturing spend for the purpose of generating rewards
- by moving or transferring Points to an ineligible third party or account
If your account is closed for any other reason, you’ll have at least 30 days from the date your account is closed to use your Points, as long as you don’t lose them for any of the reasons described in this Agreement. If you don’t use your Points during that time, you’ll lose them and they can no longer be redeemed.
CHANGES TO REWARDS PROGRAM AND/OR THESE TERMS AND CONDITIONS
Zurp reserves the right, in our sole discretion and without prior notice, to suspend, change or terminate the Rewards Program, in whole or in part; to modify, limit or suspend the use of or redemption of Points in any respect; to modify or change redemption procedures, including the number of Points required for particular Reward; and to modify, limit or suspend the collection of Points, including but not limited to imposing time limits and changes in Points values at any time. Without limitation, Zurp may:
- add new terms or delete terms
- change how you earn Points
- change how you use Points
- change what you can get with your Points
- temporarily prohibit you from earning Points, using Points you’ve already earned, or using any features of the Rewards Program
- supplement these Terms and Conditions with additional terms, conditions, disclosures, and agreements that will be considered part of these Terms and Conditions
If or when the Rewards Program is suspended or terminated, with or without prior notice, your existing Point balance may be redeemed as permitted in these Terms and Conditions for a period of six (6) months from the date of notice that the Rewards Program is suspended or terminated. Unused Points shall be void thereafter.
NOTICES
Any notices regarding the Rewards Program may be sent to you in writing, which, at our option, may be delivered to you electronically by email or through our online services, such as Zurp.com or the Zurp mobile application (the “Zurp App”).
We may also notify you of changes to the Rewards Program or these Terms and Conditions by posting an updated copy of these Terms and Conditions when you sign into the Zurp App.
We will not provide notice when we change what you can get with your Points. You understand and agree that we can make these changes at any time. You can see what you currently can get with your Points when you Sign into the Zurp App. Future availability of any specific items is not guaranteed.
HOW YOU COULD BE PROHIBITED FROM PARTICIPATING IN THE REWARDS PROGRAM
We may cancel or void your Account and your entire Points balance, and ban you from participating the Rewards Program, if you do not meet the Rewards Program eligibility requirements set forth herein, or if any Points are issued, received, redeemed, or accrued through fraud, theft, illegal means, or as otherwise not authorized in these Term and Conditions.
Further, we may temporarily or permanently, as determined in Zurp’s sole discretion, prohibit you from earning Points or using Points you’ve already earned if we suspect that you have:
- engaged in fraudulent activity related to your account or the Rewards Program.
- misused the Rewards Program in any way, for example:
- by buying or selling Points
- by selling, or participating in the sale or exchange of items and services of value obtained through use of Points
- by repeatedly opening or otherwise maintaining credit card accounts for the purpose of generating rewards
- by manufacturing spend for the purpose of generating rewards
- by moving or transferring Points to an ineligible third party or account
Accounts that have been temporarily suspended may be reinstated by Zurp, in our sole discretion, and continued participation in the Rewards Program shall be subject to these Terms and Conditions, in addition to any other requirements or limitations, as determined in our sole discretion.
OTHER IMPORTANT INFORMATION
Points are not your property and have no cash value. You cannot transfer or move Points to another account unless expressly provided for in these Terms and Conditions. Additionally, Points cannot be transferred by operation of law, such as by inheritance, in bankruptcy or in connection with a divorce.
Your participation in the Rewards Program may result in miscellaneous income received from Zurp and we may be required to send you, and file with the IRS, a Form 1099-MISC (Miscellaneous Income) or Form 1042-S (Foreign Person’s U.S. Source Income Subject to Withholding) for the year in which you participate and are awarded the benefits of this Rewards Program. You are responsible for any tax liability related to participating in this Rewards Program. Please consult your tax advisor if you have any questions about your personal tax situation.
We may assign our rights and obligations under this Agreement to a third party, who will then be entitled to any of our rights that we assign to them.
Zurp and its third-party service providers and their respective affiliates, directors, officers, employees, agents or contractors make no representations or warranties, either express or implied, including, those of merchantability, fitness for intended use or a particular purpose and otherwise arising by law, custom, usage, trade practice, course of dealing or course of performance. You release Zurp, its third-party service providers, and their respective affiliates, directors, officers, employees, agents and contractors for all activity in connection with the Rewards Program, including but not limited to, use of the Rewards Program, and any redemption for or Purchase of products or services through the Rewards Program.
You agree to indemnify and hold Zurp and its third-party service providers and all of their respective affiliates, directors, officers, employees, agents and contractors harmless from and against any loss, damage, liability, cost, or expense of any kind (including attorneys’ fees) arising from your or an authorized user’s: use of the Rewards Program, any fraud or misuse of the Rewards Program, violation of this agreement and/or violation of any applicable law or the rights of any third party.
The Creators that participate in the Rewards Program are not affiliated with us and are not sponsors or co-sponsors of the Rewards Program. Creators are subject to change with 30 days written notice.
Creators are responsible for the quality and performance of any products or services they provide. Zurp is not responsible for any aspects of the products and services provided by Creator.
The Rewards Program is void where prohibited by federal, state, or local law.
Zurp’s decisions with respect to all aspects of the Rewards Program are final and binding on all participants without right of appeal. Any attempt by you to obtain more than the stated number of Points by using multiple/different email addresses, identities, registrations and logins, or any other methods will void your Points. Use of any automated system or service to participate is prohibited and will result in disqualification. In the event of a dispute as to any registration, the authorized account holder of the email address used to register will be deemed to be the Account holder. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Any automated computer receipt or statement of account does not constitute proof of actual number of Points. Zurp reserves the right to withdraw, amend or suspend the Rewards Program (or to amend these Terms & Conditions) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond our reasonable control. Any attempt to deliberately damage or to undermine the legitimate operation of the Rewards Program in any way is a violation of criminal and civil laws and should such an attempt be made, Zurp reserves the right to seek remedies and damages to the fullest extent permitted by law.
We may enforce these Terms and Conditions at any time. We may delay enforcement without losing our right to enforce these Terms and Conditions at a later time. If any part of these Terms and Conditions is found to be unenforceable, we may still enforce the other terms.
DISPUTE RESOLUTION
Except where prohibited by law, as a condition of participating in the Rewards Program, you agree that (1) any and all disputes and causes of action arising out of or connected with the Rewards Program shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of JAMS and held at the JAMS regional office nearest to you; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than your actual out-of-pocket expenses (i.e., costs associated with participating in the Rewards Program), and you further waive all rights to have damages multiplied or increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of you and Zurp in connection with the Rewards Program, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.
Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, you agree that, by participating in the Rewards Program, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Rewards Program, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in the Rewards Program, but in no event attorney’s fees; and (iii) under no circumstances will you be permitted to obtain any award for, and you hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
PRIVACY
When registering an Account and becoming a Rewards Program member, you agree to receive promotional communications from Zurp. Information collected from Account holders and Rewards Program members is subject to Zurp’s Privacy Policy, found at www.zurp.com/privacypolicy.
OPT OUT
In order to opt out from the Rewards Program, please contact customer support at hello@zurp.com or 888-505-ZURP.
COMMUNICATIONS
We may send communications about the Rewards Program to you at any mailing or email address in our records or through our online services, such as Zurp.com or the Zurp App.
Let us know right away about any changes to your contact information by calling us at 888-505-ZURP or reaching out to hello@zurp.com.
TELEPHONE MONITORING
You agree that Zurp and its third-party service providers may listen to and record customer service telephone calls to Zurp as part of providing Rewards Program services.
